Terms of Use
These Terms of Use apply to the French Alps International Softlandings Exchange project consortium, whose member organizations include French Tech in the Alps, French Tech in the Alps - Grenoble, La French Tech Taiwan, Invest In Grenoble-Alps, Innovallée-Tarmac, Empowered Startups Ltd, Empowered Startups SAS, Ubik Ltd., HUB 621, Le Village by CA, Team Export France, and Savoie-Technolac ,(“FAISE”, “we”, “us” or “our”) website, located at www.FAISE.tech (the “Website”) and your participation in the FAISE Competitions (the “Competition”) and programming to support and facilitate FAISE Bootcamps associated with the aforementioned Competition (the “Bootcamps”). By accessing and using this Website or participating in the Competition or the Bootcamps, you shall be deemed to have accepted and agreed to the terms hereafter set forth (the “Terms of Use”). If you do not agree to the Terms of Use, please do not use this Website, or participate in the Competition, or the Bootcamps.
The Terms of Use may be changed from time to time. Changes will be posted on this page and your use of this Website after such changes have been posted will constitute your agreement to the modified Terms of Use and all of the changes.
Consent and Information Collection and Use
When you visit the Website, use the functionality contained therein and/or communicate with us via email, social media or feedback or contact forms located on the Website, or participate in the Competition, or its Bootcamps, we may ask for personal information that will be used for purposes set out in the Terms of Use. Some information is also automatically collected, such as your Internet Protocol (“IP“) address, your operating system, the browser type, the address of a referring website, your user preferences and your activity on the Website. We treat this information as personal information if we combine it with or link it to any of the identifying personal information mentioned above.
By providing personal information to us, you consent to the collection, use and disclosure of such personal information as specified in the Terms of Use. Without limiting the foregoing, we may on occasion ask you to consent when we collect, use, or disclose your personal information in specific circumstances. Sometimes your consent will be implied through your conduct with us if the purpose of the collection, use or disclosure is obvious and you voluntarily provide the information. We do not knowingly collect the personal information from anyone under the major age of consent in the jurisdiction of residence of the individual or determined based on the address of such individual. We may store and process personal information in Canada, France, Taiwan, and other countries and/or jurisdictions.
We may use your personal or account information for the following purposes:

to administer the Competition and other FAISE programs in which you participate;

to help us address problems with and improve the Website, the Competition, the Bootcamps, and/or our programs and services;

to request feedback and otherwise contact you about your use of the Website, the Competition, the Bootcamps,and/or our products and services;

to notify you about important changes to the Website, the Competition, the Bootcamps and/or our programs and services;

for our internal purposes, such as to analyze trends and statistics, for audits, to develop new programs, to enhance the Website and/or the Competition and/or the Bootcamps, to improve our programs and services, to identify usage trends and to determine the effectiveness of our promotional campaigns;

to protect the security or integrity of the Website, the Competition, the Bootcamps, and our project consortium;

to prevent, detect and investigate activity and transactions that are suspicious, fraudulent, or violate the Website Terms and Conditions or the spirit of the Competition and/or Bootcamps;

in an emergency situation to protect your personal safety or that of site visitors or any third party;

You also may provide personal information to be published or displayed on public areas of the Website or in connection with the Competition and Bootcamps, or transmitted to other users of the Website, others involved with the Competition and Bootcamps, or third parties (collectively, “User Contributions“). Your User Contributions are published or displayed on the Website or in connection with the Competition and transmitted to others at your own risk. We cannot control the actions of other users of the Website or others involved with the Competition and Bootcamps with whom you may choose to share your User Contributions. Therefore, we cannot and do not guarantee that your User Contributions will not be viewed by unauthorized persons.
Sharing of Personal Information
We may share your personal information with certain service providers, including without limitation outside shipping companies, vendors, consultants, judges, mentors, sponsors and credit card or payment processing companies (“Service Providers“). When we engage Service Providers who manage customer information on our behalf and/or perform services on our behalf, such as conducting surveys, sending communications, judging the Competition or providing mentorship in connection with the Competition, or helping prevent fraudulent transactions, we may share your personal information with such Service Providers under the requirement that such personal information is used only to provide services to us.
We are not responsible for the actions of any independent third parties you may choose to engage with directly, nor are we responsible for any additional information you provide directly to any third parties, and we encourage you to become familiar with their privacy practices before disclosing information directly to any such parties
Rights to Your Information
We strive to ensure that any personal information we retain and use is accurate, complete and up-to-date as necessary for the purposes for which we will use it. If our records regarding your personal information are inaccurate or incomplete, we will amend that information at your request.
Aggregated Data
We may also use your personal information. Website usage statistics and Competition related statistics to generate Aggregated Data for internal use and for sharing with others on a selective basis. “Aggregated Data” means records which have been stripped of information potentially identifying customers or users, and which have been manipulated or combined to provide generalized, anonymous information. Your identity and personal information will be kept anonymous in Aggregated Data.

The Website may contain links to other websites. The Terms of Use does not apply to other websites and we are not responsible for the privacy practices or the content of such websites. We encourage you to read the Terms of Use of linked websites prior to providing them with personal information. We are not responsible for, and cannot control, the use by others of any information which you provide to them and you should use caution in selecting the personal information you provide to others through the Website or in connection with the Competition or Bootcamps. Similarly, we cannot assume any responsibility for the content of any personal information or other information which you receive from other users through the Website or in connection with the Competition or Bootcamps, and you release us from any and all liability in connection with the contents of any personal information or other information which you may receive using the Website or in connection with the Competition or Bootcamps. We cannot guarantee, or assume any responsibility for verifying, the accuracy of the personal information or other information provided by any third party. You release us from any and all liability in connection with the use of such personal information or other information of others.
Warranties and Disclaimers
Your participation in the Competition and/or Bootcamps is at your sole risk. FAISE makes no representations or warranties, either expressed or implied, of any kind with respect to the Competition, the Bootcamps, the operation thereof, or the contents.
In no event shall FAISE or its sponsors, partners, jury, or mentors be liable to you or any third party for any special, punitive, incidental, indirect or consequential damages of any kind, or any damages, loss or expense whatsoever, including, without limitation, those resulting from the loss of use, data or profits, whether or not FAISE has been advised of the possibility of such damages, loss or expense, and on any theory of liability, arising out of or in connection with your participation in the Competition and/or Bootcamps. Some jurisdictions prohibit the exclusion or limitation of liability for consequential or incidental damages, so the above limitations may not apply to you.
The use of, downloading or other acquisition of any information, data or documents in relation to the Competition and/or Bootcamps is done at your own discretion and risk and you agree that you will be solely responsible for any damage to your computer system or loss of data that results from such downloading or other acquisition. No advice or information, whether oral or written, obtained by you from FAISE, any sponsor, partner, jury member, or mentor or otherwise in connection with the Competition and/or Bootcamps shall create any warranty not expressly stated in the the Terms of Use.
FAISE reserves the rights to terminate, withdraw or amend the Competition and/or the Bootcamps, to disqualify any Team or Team member, and to accept or decline any entry for the Competition and/or the Bootcamps, all for any reason and without notice.
FAISE reserves the right, in its sole discretion, to disqualify any Participant, Team, Team member or entry if FAISE determines that such party or entry violates the spirit of the Competition. In addition, FAISE reserves the right, in its sole discretion, to disqualify any Participant, Team, Team member or entry, for any reason without notice. FAISE’s decisions are final and binding.
Representation of Rights in the Work
You represent and warrant that you are the sole author of all documents and information submitted in connection with the Competition (the “Work”) and/or Bootcamps, that the Work is original and that the Work has not previously and does not presently infringe on any patents, industrial designs, trade-marks, trade names, brand names, service marks, logos or copyrights, whether or not registered and whether domestic or foreign, or the trade secrets, know-how or confidential or proprietary information of any other person or entity (the “Intellectual Property Rights”).
Indemnity
You agree to indemnify, defend and hold harmless FAISE and any sponsor, partner, jury member, or mentor and their respective officers, directors, employees, consultants, representatives and agents from and against any loss, liability, claim, cause of action, demand, damages, costs or expenses including without limitation reasonable legal, accounting and other professional fees made by any third party arising from or in connection with your participation in the Competition and/or Bootcamps including but not limited to any violation by you or any other Participant of the Terms of Use, your infringement of any Intellectual Property Rights or your misuse of any confidential information by any person. FAISE reserves the right to assume the exclusive defence and control of any matter, subject to indemnification by you, which shall not excuse your indemnity obligations.
You further agree not to make any claim or initiate any proceedings in relation to any loss, damage or expense that you may incur in connection with your participation in the Competition and/or Bootcamps, including but not limited to your entry or otherwise might claim contribution and indemnity from FAISE and any sponsor, partner, jury member or mentor and their respective officers, directors, employees, consultants, representatives and agents of the Work, against any person, partnership, corporation or other entity who might claim pursuant to the provision of any applicable statute.
No Confidentiality Obligation
FAISE understands confidentiality is a major concern to you and efforts will be made to restrict access to your entry. Nevertheless, you acknowledge that FAISE cannot ensure the privacy of any information that you send us. Without limiting the generality of anything else stated in Terms of Use, FAISE and any sponsor, partner, jury member or mentor and their respective officers, directors, employees, consultants, representatives and agents shall not be responsible for any damages that you may incur by your communication of information and entry of the Work (whether confidential or not) to FAISE or, if at your request, FAISE communicates confidential or other information to you.
Participant grants to FAISE (and its mentors and jury members) all necessary licenses in and to all information, data, or documents you submit as part of your entry or, in connection with your involvement in the Competition and/or Bootcamps, solely as necessary in order for FAISE (and its mentors and jury members) to administer and provide the Competition and/or Bootcamps, and all information provided will be treated in accordance with the Terms of Use.
Governing Law and Jurisdiction
The Competition and Bootcamps are administered by FAISE through the offices of French Tech in the Alps in France. By participating in the Competition and/or Bootcamps, you and FAISE agree that all matters relating to your participation in the Competition and/or Bootcamps shall be governed by the laws of France, and that the International Chamber of Commerce in Paris France shall have exclusive jurisdiction in respect of all disputes arising out of , the Terms of Use or any other rules or guidelines posted on this website.
Trademark Information
The FAISE trademarks, logos and service marks (the “FAISEMarks”) displayed during the course of the Competition and/or Bootcamps are the property of FAISE or other third parties. You are not permitted to use any of the FAISE Marks without the prior written consent of FAISE or such third party that may have right, title and interest to a FAISE Mark.
Participant grants to FAISE all necessary licenses in and to any Participant trademarks, logos, trade-names or service marks (the “Participant Marks”) solely as necessary for FAISE to advertise or promote the Competition and/or Bootcamps and any future competition and/or Bootcamps FAISE sponsors or is involved with, in any way.
Right to Amend the Rules
Situations not covered by the above terms of use will be resolved by the FAISE board of directors and their decision will be final. The FAISE board of directors reserve the right to amend the terms of the Competition without notice, including in the event situations occur that are not covered by the above rules or to further interpret or clarify the existing rules when necessary.
